Terms & Conditions of Sale

Art. 1 — Purpose and scope

These terms and conditions of sale ("Terms") govern the sale of handcrafted Native American flutes and accessories on the lezaart.com website ("the Site"), published by Leza Art, a French sole trader (auto-entrepreneur), 5115 route des Hauts du Camp, 83330 Le Castellet, France (see our legal notice).

Placing an order on the Site implies full and unreserved acceptance of these Terms, to the exclusion of any other document. Leza Art reserves the right to amend them at any time; the Terms that apply are those in force on the date of the order.

Art. 2 — Products

The flutes presented on the Site are handcrafted in the workshop in Provence, from noble woods, bamboo, or Provence cane. As each piece is unique (grain, colour, slight natural irregularities of the material), small variations may exist between the photographs shown and the item delivered, without this constituting a lack of conformity.

Some flutes are made to measure via the Site's configurator (wood, mouthpiece, key, tuning, personalised engraving…): see article 6 on the right of withdrawal for the specific rules that apply to these pieces.

Art. 3 — Price

Prices are shown in euros (€), all taxes included. As Leza Art operates under the French micro-entreprise (auto-entrepreneur) scheme, it benefits from the VAT exemption provided for in article 293 B of the French General Tax Code: VAT is not applicable and does not appear on invoices.

Delivery charges are shown separately before the order is finally confirmed and are added to the price of the products, except where delivery is free (see article 5).

Leza Art reserves the right to change its prices at any time; products are billed based on the price in force at the time the order is confirmed.

Art. 4 — Order

Ordering on the Site is reserved for customers with an account (free to create). The delivery address used for the order is the one registered on the account profile; the customer may, when ordering, provide a different billing address if needed.

The order process works as follows:

• select the product(s) and add them to the cart;
• sign in to the customer account (or create one);
• choose a delivery method;
• check the order summary (products, price, delivery);
• secure payment and final confirmation of the order.

Confirming the order constitutes acceptance of these Terms and of the total price due. An order confirmation is sent by email to the address associated with the account.

Leza Art reserves the right to refuse or cancel any order that appears abnormal, fraudulent, or made in bad faith.

Art. 5 — Payment and delivery

Payment is made online, by credit card, via the secure Stripe solution. The customer's banking details are neither collected nor stored by Leza Art: they are processed directly by Stripe. The order is considered final upon receipt of payment confirmation from Stripe.

Flutes are shipped to mainland France, Belgium, Switzerland, Luxembourg, and Monaco, via the following carriers (chosen by the customer when ordering):

The times given are indicative and run from the shipment of the parcel, which takes place after the order is made or prepared. Delivery is free from €70 of purchases (excluding delivery charges); this threshold and the carriers concerned may be adjusted by Leza Art.

The customer is responsible for the accuracy of the delivery address on file with their account. In the event of an issue noted on delivery (damaged parcel, missing product), the customer is invited to note their reservations with the carrier and to contact Leza Art as soon as possible.

Art. 7 — Legal warranties

All products sold on the Site benefit, as of right and at no extra cost, from the following legal warranties:

• the legal guarantee of conformity (articles L217-4 et seq. of the French Consumer Code), for defects of conformity existing at the time the goods are delivered;
• the legal guarantee against hidden defects (articles 1641 et seq. of the French Civil Code), for hidden defects that make the goods unfit for their intended use.

To make use of either of these warranties, the customer may contact Leza Art at contact@lezaart.com, specifying their order and the nature of the defect found.

Art. 8 — Liability

Leza Art cannot be held liable for non-performance of the contract in the event of a stock shortage, force majeure, total or partial disruption or strike affecting postal services and means of transport, or any other event beyond its reasonable control.

As the flutes are musical instruments made of natural materials, appropriate care (wiping down, protection from excessive humidity) is recommended; it is the customer's responsibility to follow the care instructions provided with the product.

Art. 9 — Personal data

Personal data collected as part of an order is processed in accordance with our privacy policy.

Art. 10 — Applicable law and mediation

These Terms are governed by French law. In the event of a dispute, the customer is invited to contact Leza Art first at contact@lezaart.com in order to seek an amicable solution.

Failing an amicable resolution, and in accordance with article L616-1 of the French Consumer Code, the consumer customer may make free use of a consumer mediator, or use the European online dispute resolution (ODR) platform, available at ec.europa.eu/consumers/odr.
